Contract resource obligations
  • The Contract Resource will be engaged by the Employment Business to perform services as detailed in an assignment schedule.
  • The Contract Resource shall be permitted to exercise reasonable autonomy in the method of performance of the Assignment but shall be required to comply with such reasonable policies and procedures advised by the Client as are applicable to an independent contractor.
  • The Employment Business confirms that the Contract Resource will be contractually required to exercise all due care, diligence, and professional skill in the performance of the Assignment.
  • If the Client reasonably considers the Contract Resource’s performance of the Assignment to be unsatisfactory, then the Client may request in writing the replacement or termination of the unsatisfactory Contract Resource without the need to provide the notice period of 30 days.
  • The Client will be liable to pay for all Fees incurred prior to any assignment termination.
  • To exercise its rights under this clause, the Client must provide Nebula with written confirmation detailing the specific circumstances which constitute the reasonable grounds for the Client’s dissatisfaction.
  • Nebula’s removal of the Contract Resource in response to the Client’s request shall not, in itself, constitute an acceptance or admission that the Client’s grounds are reasonable.
